As the Coronavirus (COVID-19) pandemic has impacted the United States as well as the rest of the world, people are still trying to figure out how to deal with the effects of the outbreak. Unfortunately, one of the most impacted areas has been nursing homes. This is for a variety of reasons, as the individuals within these homes are usually elderly and living in such close proximity to one another. As a result, nursing homes around the country have become an epicenter for the virus with many individuals becoming sick and suffering from fatalities.

People put their loved ones in nursing homes so that they receive the best care possible. Usually, this is the case and they live a comfortable life within these homes with the support of those who work there. While there are countless healthcare workers putting their own lives on the line during this time to protect others, there are instances of negligence that are resulting in the virus spreading rapidly throughout these homes. As of last week, the coronavirus-related deaths in nursing homes accounted for about half of the virus deaths in the state of Maryland. 

As fatalities due to COVID-19 continue, nursing homes across the country are fighting for immunity from lawsuits and other penalties. It is important to remember that, even if they do become immune, individuals can still pursue legal action for what is known as “gross negligence.” This is defined as the “lack of slight diligence or care” or “a conscious, voluntary act or omission in reckless disregard of a legal duty and of the consequences to another party.”
